Digital Millennium Copyright Act Policy

Last Updated: January 17, 2024

At Bathtub Refinishing Inc., we hold the intellectual property rights of others in high regard, just as we expect our rights to be respected. In compliance with the Digital Millennium Copyright Act (DMCA), Title 17 of the United States Code, Section 512(c), copyright owners or their representatives can forward a takedown request to us via our designated DMCA Agent. As an ISP, we claim the statutory immunity provided under the DMCA’s “safe harbor” provisions. To lodge a valid infringement complaint with Bathtub Refinishing Inc., please ensure your notice includes the following:

Infringement Notice – Submission Requirements

  1. The physical or electronic signature of the copyright owner or a person authorized to represent them;

  2. Details of the copyrighted work you claim has been infringed;

  3. Details of the infringing content to be removed, including specific URL(s) to help us locate the content;

  4. Your contact details, such as name, address, email, phone number, and fax number, to allow us to reach out to you;

  5. A declaration that you believe in good faith that the use of the content is not authorized by the copyright owner;

  6. A statement, under oath, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Be aware that under Title 17 USC §512(f), there are legal consequences, including potential liability for damages, for misrepresentations in an infringement notice.

Submit all takedown requests through our Contact page at [https://www.bathrefinishingnyc.com](https://www.bathrefinishingnyc.com). Email submissions are preferred for faster processing.

Note: We may disclose your identity and the details of your claim to the party you allege is infringing your copyright.

Counter Notice – Requesting Reinstatement of Content

If you’ve received notification that your content was removed due to a copyright infringement claim, you can submit a counter-notification for reconsideration. Written counter-notices to our DMCA Agent must include:

  1. Your physical or electronic signature;

  2. A description of the removed material and its original location on our site;

  3. A statement, under penalty of perjury, that you believe the material was erroneously removed due to a mistake or misidentification;

  4. Your contact details, and a consent to the jurisdiction of the federal court for your area, or any jurisdiction in which the service provider may be found if you’re outside the U.S. You must also agree to accept service of process from the party who filed the original infringement notice.

  5. Please send your counter-notification through our Contact page. We recommend using email for efficiency.

Policy on Repeat Infringement

We take allegations of copyright infringement with utmost seriousness. In line with the DMCA’s repeat infringer policy, we maintain records of DMCA notices and strive to identify repeat infringers. Those found to repeatedly violate our policies may face account termination.

Policy Updates

We reserve the right to amend the contents and policies outlined on this page at any time and for any reason. We encourage you to revisit this page periodically to stay informed about any changes to our DMCA handling procedures.
